The new tachograph legislation is part of the EU Mobility Package, aimed at improving social conditions for drivers, increasing road safety and offering equal access to the European markets. This new legislation makes it mandatory for all commercial vehicles over 3.5 tons to have a Smart 2tachograph installed for continued traffic to and / or between European countries. Vehicle operators can confirm the generation and version of the tachograph fitted to their vehicle(s) in the printout and/or from downloading the technical details of the tachograph, or from the manufacturer label on the tachograph.

The penalties differ somewhat between the EU member states, but in general, not having a Smart 2 tachograph installed and in use by the specified deadlines, or driving without a type-approved tachograph installed is considered a ‘most serious infringement’ (MSI) or a ‘very serious infringement’ (VSI) and could result in fines of up to €30.000.
